Bartnett v. Rogers
Appellate Court Summary: Bartnett v. Rogers, 400 S.W.3d 38 (Mo. Ct. App. 2013).
After obtaining a Taney County, Missouri trial court’s ruling in favor of defendant Roy Rogers, Jr., DSDK attorneys successfully argued on appeal for affirmation of the trial court’s decision in Mr. Roger’s favor. Specifically, the Missouri Court of Appeals (Southern District) affirmed the trial court’s findings and held that Rogers, as trustee, did not breach his fiduciary duty by failing to timely close the family museum, which had a licensing agreement with the family trust to display trust property and which had taken loans from trust.
